FotoKaki is operated by Techlaju Sdn Bhd (“we”, “us”, “our”).

1. Agreement

These Terms & Conditions (“Terms”) govern your access to and use of the FotoKaki photobooth software platform, website, kiosk interfaces, APIs, and related services (collectively, the “Service”) provided by Techlaju Sdn Bhd.

By creating an account, subscribing to a plan, operating a kiosk, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you have authority to bind that business.

2. The Service

FotoKaki is a multi-tenant software platform that lets event operators and businesses run branded photobooth experiences, including photo capture, frame overlays, QR-based sharing, storage, analytics, and billing features.

We may update, improve, or discontinue features from time to time. We will use reasonable efforts to avoid material disruption to paid subscriptions, but we do not guarantee uninterrupted or error-free operation.

3. Accounts & eligibility

  • You must provide accurate registration information and keep your login credentials secure.
  • You are responsible for all activity under your account and for users you invite to your workspace.
  • You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
  • We may suspend or terminate accounts that violate these Terms or pose a security or legal risk.

4. Plans, billing & payments

Paid plans (including subscriptions and one-time Event Passes) are billed according to the pricing shown on our website or in your dashboard at the time of purchase. Payments are processed by our payment partner, CHIP (chip-in.asia).

  • Subscription plans may include minimum terms as stated on the pricing page (e.g. a 3-month minimum on selected plans).
  • Usage limits (photos, storage, seats, templates) apply per your plan. Overage charges may apply where stated.
  • Prices are shown in Malaysian Ringgit (MYR) unless otherwise indicated.
  • Failure to pay may result in suspension of your workspace or downgrade of features.

5. Your content & guest photos

You retain ownership of content you upload (logos, frames, settings) and photos captured through your kiosk, subject to the licence you grant us below.

You grant Techlaju Sdn Bhd a non-exclusive, worldwide licence to host, store, process, transmit, and display your content solely to operate and improve the Service, comply with law, and enforce these Terms.

You are solely responsible for obtaining any consents required from event guests or subjects before capturing or sharing their images, and for complying with applicable privacy and publicity laws.

6. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, harassing, or infringing purposes.
  • Upload malware, attempt unauthorised access, or interfere with platform security or performance.
  • Resell or sublicense the Service except as expressly permitted by your plan.
  • Misrepresent your identity or affiliation, or use the Service to distribute spam.
  • Store or share content that violates third-party rights or applicable law.

7. Third-party services

The Service integrates with third parties such as CHIP (payments), EngineMailer (email), and Wasabi or similar providers (cloud storage). Your use of those services may be subject to their own terms. We are not responsible for third-party outages or actions beyond our reasonable control.

8. Intellectual property

The FotoKaki platform, software, branding, and documentation are owned by Techlaju Sdn Bhd or its licensors. These Terms do not grant you any rights to our trademarks or proprietary materials except as needed to use the Service.

9. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet every event requirement or that photos will always be recoverable after retention periods expire.

10. Limitation of liability

To the maximum extent permitted by Malaysian law, Techlaju Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from your use of the Service.

Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold harmless Techlaju Sdn Bhd from claims, damages, and expenses (including reasonable legal fees) arising from your content, your events, your misuse of the Service, or your violation of these Terms or applicable law.

12. Termination

You may cancel a subscription according to your plan terms. We may suspend or terminate access for breach, non-payment, or legal compliance. Upon termination, your right to use the Service ends; we may delete or retain data per our Privacy Policy and retention settings.

13. Governing law

These Terms are governed by the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia, with venue in Kuching, Sarawak, unless mandatory law provides otherwise.

14. Changes

We may revise these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance of the revised Terms.
